1. Who we are

These Terms & Conditions ("Terms") govern your use of the Who's Home platform, website, and related services (the "Service") provided by Who's Home ("we", "us", "our"). By accessing or using the Service you agree to be bound by these Terms.

2. Acceptance

By creating an account, running a report, or otherwise continuing to use the Service, you confirm that you have read, understood and agreed to these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization. If you are using the Service as an individual, you confirm that you are of legal age to form a binding contract.

3. The Service

Who's Home aggregates publicly available property records — including permits, incident reports, ownership history, and related signals — into a single readable report to help buyers, renters, and investors perform due diligence. Reports are informational only and are not a substitute for professional legal, financial, or inspection advice.

4. Account & credentials

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information and to keep it up to date.

5. Acceptable use

You agree not to misuse the Service. In particular, you must not:

  • use the Service for any unlawful purpose, including fraud, harassment, stalking, or discrimination;
  • use reports for decisions covered by the Fair Credit Reporting Act (FCRA) such as tenant screening, employment, credit or insurance eligibility;
  • send spam, malware, or otherwise interfere with the security or integrity of the Service;
  • scrape, probe, reverse engineer, or attempt to circumvent any technical limitation;
  • resell, redistribute, or make the Service available to third parties outside your account.

6. Intellectual property

The Service, including its software, design, branding, and documentation, is owned by Who's Home and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service within your chosen plan.

7. Payment and subscriptions

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment terms, billing, taxes, renewals, cancellations, and refunds are governed by Paddle's Buyer Terms together with our Refund Policy.

8. Service level

We work hard to keep the Service running smoothly but do not guarantee uninterrupted or error-free performance. Reports depend on third-party public records that may be incomplete, delayed, or inaccurate, and are provided on an "as is" basis. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

9. Limitation of liability

To the fullest extent permitted by law, our aggregate liability arising out of or relating to the Service is limited to the fees you paid us in the twelve (12) months preceding the claim. We are not liable for indirect, consequential, or special damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability for fraud, death, or personal injury where such exclusion is prohibited by law.

10. Suspension and termination

We may suspend or terminate your access to the Service for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. On termination, your right to use the Service ends and we may delete associated data after a reasonable export window.

11. Governing law

These Terms are governed by the laws of the jurisdiction in which Who's Home is established, without regard to conflict of law rules. Disputes will be resolved in the competent courts of that jurisdiction.

12. Changes

We may update these Terms from time to time. Material changes will be communicated via the Service or by email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
